ARTICLE XV
Intellectual Property
Section 1. The Florida Home Builders Association is the owner of valuable intellectual property rights, which are essential to its continued viability and well-being, and that of its Affiliated Local Associations or Chapters. These rights include, with limitation, Florida and/or United States service/trademarks for the marks “ Parade of Homes” and “ Future Builders of America” (“ Florida Marks”). Members of the Florida Home Builders Association agree and acknowledge that any use of the FHBA’s Marks, any formative variation of the FHBA’s Marks, or other intellectual property of the Association without the Association’s express written authorization will result in significant and substantial harm to the Association and its Affiliated Local Associations or Chapters. Members of the Florida Home Builders Association further agree and acknowledge that any such unauthorized use of the FHBA’s Marks or other Association intellectual property shall be detrimental to the Florida Home Builders Association and its affiliated Local Associations or Chapters, and shall constitute grounds for suspension and revocation of membership in the Florida Home Builders Association and its Affiliated Local Associations or Chapters.
