Suspension and Revocation of Membership 

Section 3.             SUSPENSION AND REVOCATION OF MEMBERSHIP         

  • The Board in Session, by a two-thirds (2/3) vote may suspend or revoke or non-renew the membership of any member (1) for failure to meet their financial obligations to the Association or, for conduct detrimental to this Association; (2) For violating any member obligations set forth in these by-laws or in the by-laws of the Florida homes Builders Association; (3) For violating any rule of any standing committee established by the
    Association; (4) For violating any code of professional ethics under which the member is governed; or (5) For conduct detrimental to the Association.  For purposes of this section, “ conduct detrimental to the Association’ shall include, without limitation, any of the following: (a) unauthorized use of trademarks or other intellectual property of the Association or the Florida Home Builders Association; (b) unauthorized use of confidential or proprietary materials of the Association; (c) improperly creating confusion among the public that the member of any of its programs or events are sponsored by or affiliated with the Association or the Florida Home Builders Association; (d) attempting to improperly profit from the goodwill and reputation of the Association or the Florida Home Builders Association; and (e) otherwise acting in a manner that is harmful or detrimental to the interest of the Association.

The member shall be given at least thirty (30) days notice, in advance, of the any meeting of the Board of Directors at which such a vote to suspend or revoke the member’s membership the vote is to be taken, and shall be afforded a reasonable opportunity to be heard prior to such vote taking place..

  • A vote of two-thirds (2/3) of the Board In Session shall be required to reinstate any membership suspended or revoked under this section.  Reinstatement shall be subject to such terms and conditions as the Board may impose.
  • A membership, which is revoked, shall be reimbursed on a pro rata basis for the remaining local dues, less any monies due the Association.
  • Any suspension imposed shall have a specific time limit as set forth by the Board of Directors and is to be determined at the time suspension is approved.
  • Upon the death or resignation of a member, each membership may be transferred for the balance of that membership year, to another party designated by the personal representative of the deceased or by the resigning member, in accordance with membership requirements.
